ApeOnly uses specifically developed smart contracts to enable users to own, transfer and battle with digital apes.

WE ARE ONLY WILLING TO MAKE THE SMART CONTRACTS, AND THE SITE AVAILABLE TO YOU IF YOU ACCEPT ALL OF THESE TERMS. BY USING THE SMART CONTRACTS, THE SITE, OR ANY PART OF THEM YOU ARE CONFIRMING THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY ALL OF THESE TERMS OF USE. IF YOU DO NOT AGREE AND/OR ACCEPT ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND THE SMART CONTRACTS AND YOU MUST DISCONTINUE USE IMMEDIATELY.

OWNERSHIP

1. ApeOnly Island is a collection of NFTs on the Ethereum blockchain. When you purchase an NFT, you own the underlying Island Ape and the art completely. Ownership of the NFT is mediated entirely by the Smart Contract and the Ethereum Network.

2. Personal Use. Subject to your continued compliance with these Terms, ApeOnly grants you a worldwide, royalty-free license to use, copy and display the purchased Art

3. Commercial Use. Subject to your continued compliance with these Terms, ApeOnly grants you an unlimited, worldwide license to use, copy, and display the purchased Art for the purpose of creating derivative works based upon the Art.

APEONLYS ARE NOT INVESTMENT VEHICLES

1. ApeOnlys are collectible digital art pieces that also function as fun, Non-Fungible tokens for you to collect. They were created as art pieces intended for people to enjoy by collecting, not as a financial instrument. ApeOnly makes absolutely no promises or guarantees regarding the value of ApeOnly NFTs or $Shillings.

2. $Shillings were created as a utility token with the sole purpose of changing your NFT’s clan, name, bio and as in game loot when battling other players, NOT as a financial instrument. ApeOnly makes absolutely no promises or guarantees regarding the value of $Shillings

3. ApeOnly and all linked media, contributors and team accept no liability for any loss occurred to any personal acting or refraining from action as a result of any material provided or published.

ADJUSTING OR DELISTING APEONLY ASSETS

1. ApeOnly come with the ability to change the Name and Bio of the ApeOnly on-chain by burning $Shillings token. These changes are then visible on Opensea. In the event that you change the name or bio of any ApeOnly to reflect pornography, hate speech, or other language that the community deems out of line it may be changed as we reserve the right to protect the integrity of our project.

ASSUMPTION OF RISK

1. There are risks associated with using an internet-based currency, including, but not limited to, the risk of hardware, software and internet connections, the risk of malicious software introduction, and the risk that third parties may obtain unauthorized access to information stored within your wallet. You accept and acknowledge that ApeOnly will not be responsible for any loss that may be incurred or delays you may experience when using the Ethereum network, however caused

2. Blockchain assets are volatile, we cannot guarantee that any purchaser of ApeOnly will not lose money.

3. The prices of blockchain assets are extremely volatile. Fluctuations in the price of other digital assets could materially and adversely affect the value of your ApeOnly and of $shillings. We cannot guarantee that any purchaser of ApeOnly or $shillings will not lose money.

4. ApeOnly is not responsible for any loss of private keys or passphrases. ApeOnly is not responsible for your private keys, which you need in order to access the NFTs.

TAXES

1. You are entirely and solely responsible for any tax liability which may arise from minting, selling or owning your ApeOnly NFTs.
